“The Hunger Games” book trilogy has generated a frenzy of “Twilight” proportions. Tributes-in-the-know have already marked their calendars for March  23, 2012, when the movie (click for the just-released full trailer) is set to hit theaters. a month before that, fans of the young adult fiction series would have been clamoring to get their hands on a line of “Hunger Games”-inspired nail polishes. but sometimes, the rules of the game change unexpectedly.

The buzzed-about nail line is no more.

Last week the company set to make the polish, American International Industries, filed a suit for breach of contract against Lionsgate Films, the studio behind the movie. the company is seeking an excess of ten million dollars, which includes “millions of dollars of materials,” “millions of dollars in lost profits,” as well as “substantial damages to American’s reputation and goodwill,” according to a complaint filed on November 23 in the Los Angeles Superior Court. They claim the studio reneged on the deal just three weeks after signing it, after the details of the nail polish collaboration were supposedly leaked and posted on blogs.

The planned the Hunger Games polish line, shown on Fashionista.com, was going to include 12 colors – perhaps to represent the 12 Districts. Now the line seems as buried as District 13.

Court documents obtained by TODAY.com indicate that the collaboration was set to include 12 colors themed after the film, and that Lionsgate initially expressed excitement over the line. but according to the complaint, on or about November 15, Lionsgate reportedly stated to the press that the contract “was not happening.” Shortly afterward, counsel for Lionsgate sent an email to American claiming it was “terminating” the contract, citing the “leak” as its basis.  

American claims in its complaint the studio had no right to do so unilaterally. “American has requested and demanded that Lionsgate comply with its obligations under the contract, but Lionsgate has steadfastly failed and refused to do so.” Representatives for both parties declined comment.

Perhaps it’s for the best: Choosing a favorite color would have been harder than choosing between Peeta and Gale, Katniss’ dueling love interests. the line-that-never-was was rumored to include:

Come February, instead of showing your allegiance with the flash of your fingertips, you’ll have to settle for wearing your Team Gale or Team Peeta T-shirts.
